What is a Form 2 and why is it needed?

Since 1 August 2025, the Property Law Act 2023 requires most Queensland property sellers to provide a Seller Disclosure Statement (Form 2) to a prospective buyer before the buyer signs a contract.

The Form 2 provides the buyer with information about the property, including title information, encumbrances, zoning, tenancy status, and outstanding notices or orders. Additional information and documents may also be required depending on the property (for example, properties within a community titles scheme have additional disclosure requirements).

The purpose of the Form 2 is to ensure that buyers receive important information before they commit to buying a property.

If a seller fails to comply with the disclosure requirements, there may be serious consequences. If a Form 2 is not provided to the buyer before signing or if the information disclosed was inaccurate or incomplete in relation to a material matter, the buyer may have a right to terminate the contract up until settlement.

Our Process

Firstly, we provide you with our Seller Disclosure Questionnaire which can be completed online or by hand. This provides us with the necessary information about your property and the searches that need to be ordered.

Once you have completed our Questionnaire, our team will arrange the searches. Typically this includes a current title search and survey plan along with other relevant searches.

Once search results are received, our solicitors prepare the Form 2 usually by the next business day. We ensure that it complies with disclosure requirements. The Form 2 will be sent to the seller for electronic signing and then provided to the real estate agent to give to prospective buyers.

Planning to Sell?

Preparing the Form 2 early can help avoid delays when a buyer is keen to sign. Before the property is advertised is the best time to get it sorted.

If you are selling, our team can prepare the Form 2 swiftly.

Please feel free to contact us if you are preparing to sell your property!
